(hereinafter: “Website Operator” or “Operator”)
1. Scope and Definitions
- The term “website” encompasses all websites published by the Operator.
- These Terms of Use apply to all content, information, offers, and services, regardless of type, collectively referred to as (“services”), provided by the Operator on the available websites. By using the services, you accept these Terms of Use. The use of websites accessed by the user via hyperlinks (third-party websites) is not covered by these Terms of Use, and the Operator assumes no responsibility for them.
- “Users” are all individuals who access and use these websites.
- “Members” refers to individuals who reside in the Republic of Croatia, are over the age of 16, and register in the membership area of any of the websites using a username and password.
- “Participants” are natural persons who reside in the Republic of Croatia, are over the age of 16, and take part in the Operator’s prize competitions.
- Users can contact the Operator via email at: [email protected].
- The Operator reserves the right to unilaterally amend the Terms at any time. The amended Terms will be published on the website and shall become effective for users immediately upon publication. The current Terms of Use and the date of their latest update are available on the website at all times. The Operator will also notify newsletter subscribers of such changes by sending the amended Terms to the email address provided during registration. Objections to the amended Terms may be submitted within 4 weeks; otherwise, the changes will be considered accepted.
2. User Code of Conduct
2.1. The User agrees to use the content provided by the Website Operator solely for its intended purpose and not for any fraudulent purposes. The User shall refrain from any actions that may harm, endanger, or discriminate against the Operator or other users. The use of the website and its content for unlawful purposes is strictly prohibited. In particular, the Operator prohibits discrimination and degrading statements based on religion, gender, racial or ethnic origin, sexual orientation, disability, age, political beliefs, and union membership. The Operator also prohibits actions that present the Operator in a negative light.
2.2. The Operator reserves the right to delete information that contains unlawful content or contradicts public morality. The Operator also reserves the right to block access to such content.
2.3. The User is responsible for keeping their access credentials confidential and protecting them from unauthorized access by third parties. If the User discloses their login information to third parties, they are liable to the Operator for any resulting damages. The User is obliged to immediately notify the Operator of any unauthorized use of the website content of which they become aware.
3. Usage Rights and Copyright
3.1. The content on the website is subject to copyright.
3.2. Unless otherwise indicated (e.g., when a source is provided), the Operator or an affiliated group company holds exclusive rights to all content used on the website, such as graphics, images, displays, and illustrations. Users may use the content found on the website solely for personal informational purposes; any modification, reproduction, distribution, inclusion, or other forms of reproduction of the content are prohibited without the prior written consent of the Operator.
3.3. If a user publicly provides information via the website (e.g., on a forum), the Operator is not liable for any third-party claims arising from such user submissions. The User agrees to fully indemnify and hold the Operator harmless from such claims.
4. Liability
4.1. To fully utilize the content on the website, the Operator recommends using the latest versions of technologies (browsers) or enabling them (e.g., activating JavaScript). Using older technologies may limit users’ access to certain features of the website.
4.2. The Operator has made all reasonable efforts to ensure that the information available on the website is accurate and complete at the time of its publication. However, the Operator is not liable for meeting user expectations related to the website.
4.3. The Operator does not guarantee for the content, information, or programs distributed through the Internet, nor is the Operator liable for any resulting damage, except where such damage was caused intentionally or through gross negligence of the Operator. This applies to all types of damage, including errors, delays, or interruptions in transmission, technical malfunctions or service failures, incorrect or incomplete content, data loss or deletion, viruses, or any other issues arising from the use of the website.
4.4. Notwithstanding the above, the Operator shall not be liable for consequential damages, lost profits, data loss, or material damage.
4.5. The Operator notes that it has no influence over the content and design of third-party websites accessible via hyperlinks. The Operator assumes no responsibility for the accuracy, completeness, or timeliness of third-party websites and does not guarantee that such websites are free from viruses or other harmful components.
5. Data Usage
5.1. If the use of content requires the collection of personal data (e.g., for registration, participation in competitions, or newsletter subscription), the data provided by the user will only be used to provide the requested services. Data will not be shared with third parties unless necessary to provide the services, in which case the user will be informed. In such cases, the Operator will ensure that the data recipient is obliged to comply with data protection laws and is not allowed to use the data for their own or advertising purposes. The Operator will implement appropriate technical and organizational measures to protect personal data.
5.2. General information and data are collected and processed in an anonymized form for statistical purposes when the website is used (e.g., number of page views, number of downloads of specific documents, user’s country of origin). These statistics are used to modify the website to better suit users’ needs.
5.3. If a user consents to receiving the newsletter, the Operator will periodically send the requested newsletter to the email address provided by the user, using the user’s name and surname, as indicated during newsletter registration. Depending on the newsletter, users will receive current information about promotions, competitions, offers, events, news, and specific topics related to the Operator. Users can unsubscribe from the newsletter at any time, free of charge. A link to unsubscribe is provided at the end of each newsletter.
5.4. All requests for information regarding user data, inquiries about the use or deletion of user data, and revocations of consent for data usage can be sent in writing to: [email protected]
6. Cookies
6.1. Cookies are used when the website is visited. Cookies are small text files that may be stored on the user’s computer and deleted later, allowing the personalization of website content. The Operator uses cookies to ensure the proper functioning of the website and to continuously improve and adapt its content to users’ needs. The Operator therefore uses functional and essential cookies on various parts of the website to, for example, verify your identity during login, identify your browser and settings, or simplify access to certain services. Unless otherwise consented to by the user, the information collected by the cookies is not personal (i.e., the user cannot be identified). Cookies are automatically deleted at the end of a website visit or, at the latest, 10 days thereafter.
6.2. Users can configure their browser settings to accept cookies on a case-by-case basis or to reject them entirely. For technical reasons, rejecting cookies may result in limited or impaired use of the website or certain services.
7. Matomo
7.1. The website uses Matomo, a web analytics service provided by InnoCraft Limited (“Matomo”). Matomo uses “cookies”, which are text files stored on your computer that enable analysis of your website usage (see previous section). The information generated by the cookie about your use of the website is transmitted to the server of SPAR Business Services GmbH. Settings ensure that your IP address is anonymized before geolocation and replaced with a generic IP address before storage.
Matomo uses this information on behalf of the website operator to evaluate your website usage, compile reports on website activity, and provide other services related to website and internet usage to the operator. The IP address transmitted by your browser through Matomo is anonymized and not merged with other data from the website operator. You can prevent cookie storage by adjusting your browser software settings; however, please note that in this case, you may not be able to use all website functions fully. You can also activate or deactivate Matomo using the “Marketing Cookies” or “Statistics Cookies” slider.
8. Final Provisions
8.1. Croatian law applies to the access and use of the website.
8.2. To the extent permitted by law, any disputes arising directly or indirectly from the use of the website that cannot be resolved amicably shall fall under the exclusive jurisdiction of the competent court in Zagreb.
8.3. If any provision of these Terms is declared void or unenforceable, this shall not affect the validity of the remaining provisions.
